Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Purchases

Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Photography Terms and Conditions of Service

Copyright
The 1988 Copyright Act assigns copyright to Gail Rajgor (Gail Rajgor Photography). It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created by Gail Rajgor Photography, even where it is part of your photoshoot arrangement, without permission in writing from Gail Rajgor.
Copyright for all material on www.gailrajgor.com is retained worldwide by the Photographer, Gail Rajgor trading as Gail Rajgor Photography. Gail Rajgor Photography reserves the right to display images at its discretion (see Photography section below for further details). Please note, while copyright is assigned by law to Gail Rajgor (Gail Rajgor Photography), a range of licence agreements are available so you can purchase any photos for whatever use (including unlimited use).
Photography
The photographer’s judgement in all matters regarding locations, composition, poses, number of photographs taken, post-production styling and all such like matters shall be deemed to be correct. Prior to a photoshoot, where appropriate, you will be required to sign a standard image release form, confirming your consent to allow Gail Rajgor (Gail Rajgor Photography) to capture images of you (or your child where appropriate) at a specified event and use those images for standard promotional purposes (eg. the front of our website). At all times, we will of course, act responsibly and abide by any wishes that your photos be kept strictly private – as standard, all your final photos are uploaded to a private client gallery with a unique ID password given only to you, unless you ask or allow that gallery to be made public. You chose who you share your gallery ID password with.
From our perspective, a happy client with a beautiful set of photos is our ultimate aim. So, if you would prefer us not to use any of your photos for any marketing purposes (for example on the front of our website) we are happy to provide confirmation of “privacy” and “no marketing use” in writing. Please note, this would in no way relinquish our hold on copyright however and those same rules (above) apply.
For a lot of Event Photography (eg. a public event), it is not always possible for us to get everyone’s prior permission for their image to be taken but all attempts to do so will be made where we can. As standard we will require the client hosting the event to seek those permissions on our behalf where they can and it is assumed that those attending the event will have been notified by the client of our presence at the event. We will always abide by any specific requests to remove an image from our website or social media pages and request that you notify us as soon as possible in such an instance. As standard practice, we would not licence for use by a third party any image of a person for which we do not hold written consent.
Photoshoot bookings
All bookings are subject to availability. All bookings take place either at client’s home, business location, or at an alternative agreed location and will be confirmed (wherever possible) by email, post, text message, or social media messaging (eg Facebook private message). Exceptions to this may be when booking takes place at short notice.
Changing bookings
If, after receiving your confirmation, you need to change your booking appointment, please call Gail immediately on 07921 258583.
Bookings can be changed free of charge if you give at least 48 hours notice. For clients that give the photographer less than 48 hours notice, this change may be subject to an administration fee of £20.
No shows
If for any reason after receiving your confirmation, you fail to attend your photoshoot appointment, a £30 “no-show” may apply for each appointment. This is to cover the cost of the time already booked with your photographer.
Cancelling appointments
If, after receiving your confirmation, you cancel your appointment less than 7 days before the shoot, an administration fee of £20 per appointment may be charged. Appointments can be cancelled 7 days or more before the shoot at no charge.
Payment
In some instances a deposit is payable to secure a required date for a photoshoot. The deposit will be deducted from your final invoice. Payment for all product orders is required at the time of ordering unless a specific agreement to the contrary has been made between Gail Rajgor Photography and the client. Products can be ordered directly by the client from their private gallery (our private gallery host provider, Zenfolio, operates a secure payment method for all orders) or by Gail on behalf of the client following a gallery review consultation with the client.
Failure
Whilst every care is taken at every stage of the photographic process, Gail Rajgor Photography shall not be liable to the client for any failure, in whole or in part, to fulfil his obligations of a booking where failure arises as a result of an event or circumstance beyond our control, which may include (but not limited to) equipment failure, inclement weather, illness or injury.
Gail Rajgor Photography can not accept any responsibility for any losses incurred as a result of any such failure beyond a full refund of the original photo shoot fee.
Photos sent by mail
Gail Rajgor Photography and its third party suppliers make every effort to deliver photographs and associated products without risk of damage, however we accept no responsibility for damage to any photographs whilst in transit if they are posted to you.
Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by the Client or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
Failure by the client to pay for any delivery when due shall entitle us to withhold further deliveries and the Client shall be liable for any costs incurred by the Supplier relating to such Goods which the Supplier is then entitled to withhold.
Delivery of the Goods shall be made to the Client’s address, unless otherwise specified, and the Client shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
Gift Vouchers
Gift vouchers may be used to book a photo shoot at any time within a year of the date of purchase. Gift vouchers to a specific value can be used against photoshoots and/or print products. Gift Vouchers cannot be redeemed for cash in part or whole.
Privacy
We shall not use your email address or any other contact details for any purpose other than communications about your photoshoot and images or to advise you of products, services and special promotions.
Gail Rajgor Photography may contact you by post, telephone, SMS text or email. But we will not sell or pass on your email address to anyone else.
With the exception being those limited photos we choose to use for marketing purposes, your online images/gallery can only be seen by logging in to your client gallery using the log-in details provided to you by us. We will not, however, be held responsible for any hacking or other activity that bypasses this process – in the event of any such hacking occurring we will act immediately to notify you and change all passwords etc.

Complaints
The client should raise any complaints with Gail Rajgor Photography in writing or email within 14 days of the client’s images being received.
Changes to Terms and Conditions
Our mission is to provide a quality service to clients. In order to do so we must reserve the right to change our terms and conditions without notice at any time.
If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
